1. Nature of Services
All services are provided as independent mandate services under Art. 394 ff. of the Swiss Code of Obligations (OR).
The Provider:
Is self-employed
Is not an employee of the Client
Does not provide medical, therapeutic, psychological, nursing, security, or legally regulated escort services
Provides social companionship only in a non-commercial intimate sense
2. Personal Responsibility
Clients expressly acknowledge that:
Participation in walking tours, lessons, moving assistance, garden work, and social outings involves inherent risks.
They participate voluntarily and at their own risk.
They are physically and mentally capable of participating. (The Provider does not assess medical fitness.)
3. Alcohol & Social Events
Each party is solely responsible for their own alcohol consumption.
The Provider assumes no responsibility for decisions made by the Client before, during, or after social outings.
The Provider is not liable for third-party venues, event organizers, or other guests.
4. Dog Owner Responsibility
The Client remains legally liable for their animal pursuant to Art. 56 OR.
The Client confirms:
Valid liability insurance
Disclosure of behavioral risks
5. Moving & Physical Assistance
The Client is solely responsible for:
Adequate insurance
Proper packaging
Safe equipment
Compliance with safety standards
The Provider may refuse unsafe tasks.
6. Limitation of Liability
To the extent permitted by Swiss law:
Liability is limited to intent and gross negligence.
Liability for slight negligence is excluded.
Liability for indirect damages, consequential damages, and loss of profit is excluded.
Total liability is limited to the amount paid for the respective service.
Mandatory statutory liability remains reserved.
7. Cancellation Policy
24+ hours: free
<24 hours: 50%
8. Insurance
Clients are responsible for maintaining:
Personal liability insurance
Accident insurance
Dog liability insurance (if applicable)
The Provider maintains appropriate insurance where legally required.
9. Data Protection
Data is processed in accordance with the revised Swiss Data Protection Act (rev DSG) and used only for contractual purposes.
10. Governing Law
Swiss law applies exclusively.
For private clients, jurisdiction is determined in accordance with Swiss consumer protection provisions (Client’s residence or Canton of Bern).
